What types of marriages does Texas recognize?



Texas does not currently recognize same-sex marriages. Texas recognizes only two types of marriages, ceremonial and informal. Ceremonial marriages generally occur after a marriage license is issued and an individual authorized under the law to marry couples performs the ceremony. In Texas, you must obtain a marriage license at least 72 hours before the marriage can be performed. After the 72 hours waiting period (3 days), the ceremonial marriage may be taken either in court or by an individual who can legally performs the marriage ceremony.



Informal marriages or “common law” marriages are also recognized by Texas courts. Informal marriages can be proven by a writing signed by the parties declaring the marriage or by providing proof that the man and woman agreed to be married and after the agreement they lived together in Texas as husband and wife and they represented to others that they were married. Affidavit of witnesses can be admitted to show evidence that the couple represented to others as a married couple. Since in Texas you cannot be married to two people at the same time, you cannot have an informal marriage to one person while you’re are still married to another.
