How long can a protective order last?
Generally, a protective order cannot exceed two years from the date the order is issued. If a time period is not stated in the order, the order only lasts until the second anniversary of the date the order was issued. A party subject to a protective order can file a motion asking the court to review the protective order to determine if there is a continuing need for the order not earlier than the first anniversary of the signing of the order. If the court finds that there is a need for the protective order, the order remains in place until the date the order expires. If the court finds the order is no longer needed, the court must order the protective order expires on a date set by the court. If a person who is the subject of the protective order is confined or imprisoned on the date the protective order is set to expire on its 2-year anniversary, the order is extended to expire on the first anniversary from the date the person is released from confinement.
