What is a protective order?
The Texas Family Code Chapters 82 through 87 govern protective orders. In short, protective orders are state court orders put in place to keep one or more people from harming others. Protective orders attempt to control someone’s behavior dictating what he or she can and cannot do. Typically, protective orders limit how close a person can come to you, your home, your school or workplace and your children. In the event someone under a protective order violates that order, the police can intervene to protect you. The following are some, but not all, of the activities that can be controlled by a protective order:
Unless the person is a peace officer actively employed in that capacity by a state agency, s/he must turn over any firearms to local law enforcement;
Stay away from your house, job or school;
Cease any behavior that causes harassment, embarrassment, annoyance, or abuse to the one protected;
Attend mandatory counseling;
Cease communication with you or with a family member;
Cease committing acts of violence (family or dating);
Cease disposal or any transfer of property (personal or real);
Make child support payments;
Removing your child from your possession or from the court’s jurisdiction; and
Cease threatening you or a family member or anyone covered under the protective order.
