Can fees be awarded to the party who successfully obtains a protective order?



Yes. The Texas Family Code §81.003 states “Except on a showing of good cause or of the indigence of a party found to have committed family violence, the court shall provide in a protective order that the party against whom the order is rendered pay the $16 protective order fee, the standard fees charged by the clerk of the court…the costs of court, and all other fees, charges, or expenses incurred in connection with the protective order.”



Further, §81.005 allows for the collection of attorney fees against the party found to have committed family violence or who has agreed to the protective order. The determination of the amount of attorney fees payable in made in consideration of the income and ability to pay of the person against whom the fees is assessed.



It should be noted that a protective order rendered in a case is immediately appealable except if the order was rendered in suit for dissolution of a marriage, then the order is only appealable at the time the final decree becomes final. Or, in the case of a suit affecting the parent-child relationship (SAPCR), the protective order may not be appealed until the time the order providing for support, possession or access of the child becomes final and appealable.
