In Texas, can a spouse be held liable for the actions of the other spouse?
Yes, under certain circumstances. Personal liability attaches if:
the liable spouse acts as an agent for the person (marriage in and of itself does not create agency for liability); or
the spouse incurs a debt for necessaries.
Associated with spousal liability is issue of whether one spouse’s separate property can be subject to the other spouse’s liabilities. In Texas, a spouse’s separate property is NOT subject to the other spouse’s creditors’ claims unless both spouses are liable under a different law. For example, if a spouse offers his separate property as collateral for the other spouse’s loan, then the collateral is subject to the liability because it has been specifically pledged as collateral. .
