Can separate property be changed to community property, and vice-versa?
Yes. Texas law provides for both pre- and post marital agreements that can specify the character of property, thereby changing it. This concept is also called “transmutation” in many community property states. In Texas, upon agreement of the parties, the character of both separate and community property can be changed. Both types of agreements must be in writing and signed by both parties with full disclosure of all assets owned by the parties. There are other formal requirements for these agreements to be enforceable, so check with a family law attorney prior to entering into one of these types of agreements. There is no requirement that the agreement be supported with consideration. That is, neither party is required to give the other party something of value to secure each other’s performance under the agreement.
