Two Types of Protective Order
There are two types of protective orders, temporary and permanent. Temporary orders can be had ex parte or without the subject of the order present in court. The application for the order must have a detailed description of the circumstances and facts surrounding the alleged family violence and an explanation of why the order is needed and it must be signed under oath by the each applicant stating that the facts and circumstances set forth in the application are true to the best knowledge and belief of each applicant.
A temporary protective order is good for twenty days and may be extended for additional twenty-day periods under certain circumstances. If the party affected by the protective files a motion to vacate the order, the court will set the motion for hearing as soon as possible.
